How do I make a claim?

Please contact our team of specialist solicitors and they will guide you through the process. Although the process can be complicated our solicitors have many years of experience and are able to guide you through the process one step at a time.

Who is the claim against?

Our team may be able to help you make a claim for compensation against your tour operator pursuant to The Package Travel, Package Holidays and Package Tour Regulations 1992 (“Regulations”) or against your cruise line operator or the hotel. The Regulations state that the tour operator is responsible for the “proper performance of obligations under contract”. If you develop a sickness abroad then this may be as a result of the tour operators failure to perform their obligations under the contract.

The amount of compensation varies and no two cases are identical. However, as an estimate for food poisoning claims then the following table may be useful:

How long will it take to receive my componsation

If the matter is straightforward and liability is admitted then the matter can take up to 12 months to settle. However, it is important to note that as the claim is made outside of the UK the other side have 6 months to investigate and either admit or deny liability

What can cause holiday illness?

There are a number of reasons why you could become ill abroad and in our experience some of the following are the usual reasons:

  1. Food has been reheated or has simply been left;
  2. Files and insects have contaminated the food and they have transferred faecal matter;
  3. Fruits and salads have been washed with tap water;
  4. Food has not been cooked properly – examples of this can be runny eggs which is a known cause of salmonella;
  5. Ice cube made of tap water in drinks; and
  6. Swimming pools are a common cause of sickness outbursts at hotels as people who are sick can transfer their germs and certain parasites are resistant to the chlorine in the water.

Regardless of any of the above the tour operator is responsible for the failings and you are entitled to receive compensation.

How much will making a claim cost?
